8. Dispute Resolution: Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS.

You agree that any and all claims or disputes arising from or related to these Terms or your use of the Site will be resolved by final and binding arbitration on an individual basis.

Class Action Waiver: You agree to waive any right to participate in a class-action lawsuit or class-wide arbitration. All disputes must be brought in your individual capacity only, and not as a plaintiff or class member in any purported class or representative proceeding.

Waiver of Jury Trial: By agreeing to arbitration, you and GovernmentShutdown.net are each waiving the right to a trial by jury.

9. Termination

We reserve the right, in our sole discretion, to suspend or terminate your access to the Site, without notice, for any conduct that we believe violates these Terms or is harmful to other users or our interests.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of South Dakota, without regard to its conflict-of-laws principles. Subject to the binding arbitration clause above, you agree to submit to the exclusive jurisdiction of the state and federal courts located within South Dakota.

11. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

12. Changes to the Terms

We reserve the right to amend or modify these Terms at any time without prior notice. Revisions will be posted on this page with an updated “Effective Date.” Your continued use of the Site following the posting of changes constitutes your binding acceptance of those modifications.
